This sixth volume (2015) of the European Yearbook of International Economic Law puts a particular emphasis on non-tariff barriers (NTBs) to trade and the world trade order. With the steady reduction of tariff rates since the GATT 47 came into force, focus in recent years has been on the vast and complex landscape of non-tariff barriers to trade. States as well as scholars seemingly struggle with the multitude of measures pooled under this expression as there is no single, acknowledged definition of the term, and its relation to the term “non-tariff measures” remains equally blurred. Particularly in practice and on a multilateral level, there appears to be some awkwardness when it comes to coping with NTBs since multilateral trade rules seem to be in conflict with national regulatory autonomy in the pursuit of policy objectives. In part one, this volume sheds light on the problems of non-tariff barriers to trade that arise in various fields. Part two focuses on regional integration with an emphasis on relations between East Asia and the European Union. In this regard, the authors outline the trade and investment relations between the European Union and East Asia, including Japan, Korea and Singapore. Part three offers an overview of recent institutional developments in WIPO, ICSID, WTO and WTO jurisprudence. Part four includes book reviews of recent works in the field of international economic law, and part five introduces a new section on publications in the field of international economic law that were released in 2013 and 2014.

Trade Policy between Law, Diplomacy and Scholarship

Das Bundesverfassungsgericht hat mit seinem Urteil zur Online-Durchsuchung am 27. Februar 2008 für einen «Paukenschlag» gesorgt. Rund 25 Jahre nach dem Volkszählungsurteil wurde erstmals wieder ein neues Grundrecht durch das höchste deutsche Gericht begründet. Das Grundrecht auf Gewährleistung der Vertraulichkeit und Integrität informationstechnischer Systeme soll im Zeitalter der digitalisierten Welt einen umfassenden Schutz für die Nutzer der Informationstechnik gewährleisten. Der Autor untersucht das neue Grundrecht unter verschiedenen Gesichtspunkten. Zunächst wird die Entstehungsgeschichte unter Einbeziehung des BVerfG-Urteils beschrieben. Anschließend werden die unmittelbaren Konsequenzen der Entscheidung für das Nachrichtendienst-, Polizei- und Strafprozessrecht dargestellt. Besonderes Augenmerk wird zudem auf die Konkretisierung der neuen grundrechtlichen Gewährleistung gelegt. Anhand der Untersuchung von Ermächtigungsgrundlagen zur Online-Durchsuchung für das Bundeskriminalamt und die bayerischen Sicherheitsbehörden werden die vorher erarbeiteten verfassungsrechtlichen Grundvoraussetzungen praktisch angewendet. Abschließend werden Perspektiven für das neue Grundrecht im Zivil- und Strafrecht aufgezeigt.

This open access book presents the proceedings of the 3rd Indo-German Conference on Sustainability in Engineering held at Birla Institute of Technology and Science, Pilani, India, on September 16–17, 2019. Intended to foster the synergies between research and education, the conference is one of the joint activities of the BITS Pilani and TU Braunschweig conducted under the auspices of Indo-German Center for Sustainable Manufacturing, established in 2009. Die gemeinsame Handelspolitik (GHP) der Europäischen Union (EU) rückte zuletzt immer häufiger in den Mittelpunkt medialer Aufmerksamkeit. Der vorliegende Tagungsband setzt eine Reihe GHP-bezogener Bände fort und geht der Frage nach, inwieweit die GHP nach den umfangreichen Reformen im Rahmen des Vertrags von Lissabon einen geeigneten verfassungsrechtlichen Rahmen für die internationale Handelspolitik im 21. Jahrhundert bildet. Im Ergebnis zeigt sich, dass die Konstitutionalisierung der GHP durch den Vertrag von Lissabon eher asymmetrische Züge aufweist: Während die demokratische Rückbindung massiv ausgeweitet wurde, führt u. a. die fortgesetzte Ablehnung einer unmittelbaren Wirkung von Handelsabkommen zu einer Schwächung rechtsstaatlicher Elemente. Das entspricht dem Trend einer allgemein stärkeren Betonung national-staatlicher Souveränitätsrechte rund um den Globus, stellt aus verfassungsrechtlicher Perspektive gleichwohl einen Rückschritt oder zumindest das Fehlen von Fortschritt dar.

After the IPS2 conferences in Cranfield and Linköping in 2009 and 2010 the 3rd CIRP International Conference on Industrial Product Service Systems (IPS2) 2011 takes place in Braunschweig, Germany. IPS2 itself is defined as “an integrated industrial product and service offering that delivers value in use”. The customers expect comprehensive solutions, which are adapted to their individual needs. IPS2 offers the possibility to stand out from competition and for long-term customer loyalty. Particularly in times of economic crisis it becomes apparent which producing companies understand to satisfy the needs and requirements of their customers. Especially in this relatively new domain IPS2 it will be important to keep track of the whole context and to seek cooperation with other research fields and disciplines. The 3rd CIRP International Conference on Industrial Product Service Systems (IPS2) 2011 serves as a platform for such collaborations and the discussion of new scientific ideas.
